IN NO EVENT SHALL WELLMONT ACADEMY BE LIABLE FOR ANY LOSS, CLAIM, DAMAGES, OR COST (INCLUDING, WITHOUT LIMITATION, LOST PROFITS, BUSINESS INTERRUPTION, CONSEQUENTIAL, INDIRECT, OR INCIDENTAL DAMAGES, OR LOST INFORMATION) ARISING OUT OR RELATED TO OF THE USE OF OR INABILITY TO USE OUR SITE, SERVICES OR PRODUCTS, EVEN IF WELLMONT ACADEMY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL WELLMONT ACADEMY BE LIABLE FOR LOSS OF DATA OR FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL (INCLUDING LOST PROFIT), OR OTHER DAMAGES BASED IN CONTRACT, TORT OR OTHERWISE. THE FOREGOING EXCLUSIONS APPLY TO THE EXTENT PERMITTED BY APPLICABLE LAW IN THE APPLICABLE JURISDICTION. FASTLINE MEDIA’S AGGREGATE LIABILITY UNDER OR IN CONNECTION WITH THE TERMS AND CONDITIONS WILL BE LIMITED TO THE AMOUNT PAID FOR THE SERVICES OR PRODUCTS, IF ANY. THIS LIMITATION WILL APPLY EVEN IN THE EVENT OF A FUNDAMENTAL OR MATERIAL BREACH OF THIS TERMS AND CONDITIONS.

IN THE EVENT OF ANY PROBLEM WITH THIS SITE, THE PRODUCTS OR SERVICES PROVIDED, YOU AGREE THAT YOUR SOLE REMEDY IS TO CEASE USING THIS WEBSITE OR SAID PRODUCTS OR SERVICES PROVIDED. FASTLINE MEDIA IS NOT LIABLE TO YOU OR TO THIRD PARTIES FOR ANY DAMAGE, HARM, INJURY OR CLAIM THAT ARISES FROM YOUR USE OF ANY SERVICES OR PRODUCTS PURCHASED FROM OUR SITE.

You may not claim intellectual or exclusive ownership to any of our curriculum, methods, practices, products or services, modified or unmodified. All products are property of Wellmont Academy. Our products and services are provided “as is” without warranty of any kind, either expressed or implied.

3. Warranty
Our products and services are offered without warranty and there is no guarantee that the outcome of the products or services rendered. 

Wellmont Academy does not provide any warranty for our products or services, educational methods or techniques in any manner. The result of our products and services is wholly dependent on the parent or guardian following through on the products or services rendered.

4. Payments and Price Changes
If interested in purchasing any of our services or products, you will be required to submit payment information. We accept checks and money orders and offer electronic payments through PayPal if agreed to in writing by the customer. You must agree with their Terms and Conditions before paying for any of our products. If purchasing an annual subscription, your subscription will automatically renew at the end of each year automatically unless you request a cancellation from Wellmont Academy. You will be notified automatically before your renewal date in the event you would like to cancel your annual subscription.

Wellmont Academy reserves the right to modify or discontinue, temporarily or permanently, prices of all products or subscriptions, including monthly or annual subscription fees, at any time with or without notice. Such notice may be provided at any time by posting the changes to the Wellmont Academy Terms and Conditions.

5. Refund Policy
Withdrawal up to and including the 4th week of school during any semester will result in a prorated refund for that semester's tuition, excluding non-refundable deposits, classroom supply fees, and lab fees. Wellmont Academy assesses a $50 withdrawal fee per student, used to cover administrative costs, facilities usage, and insurance.

Withdrawal after the 4th week of school each semester, no refund is issued. If yearly tuition is has been paid in full and withdrawal is initiated in the first semester, the second semester's tuition will be refunded in full. Refunds are based solely on a full withdrawal, not on partial participation.

6. Indemnity
You agree to indemnify and hold Wellmont Academy, officers, directors, employees and agents, harmless from any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from through use of our services or products, educational methods or techniques, your connection to our service or products, your violation of the Terms and Conditions, or your violation of any rights of another.

7. Suspension and Expulsion
Wellmont Academy in its sole discretion, has the right to suspend or expel any student at any time for any reason per Wellmont Academy's Student and Parent Handbook, which is available to parents and students upon becoming a student at Wellmont Academy.

8. Newsletter
By becoming a student or parent of a student of Wellmont Academy, you acknowledge and agree to be signed up for our newsletter which will be sent to you occasionally for informational purposes. You are free to opt out at any time by clicking on the link provided in the newsletter. We do not give your personal information to any 3rd party companies as mentioned in our Privacy Policy.
